Article 1 | Compliance to the present general services conditions

The present general conditions define and regulate the relations between Gil Filiot, Private French Teacher online, and his clients-students. Because of the ordering of a French Class with Gil, and from the moment of the ordering, clients and/or students de facto comply with the present general conditions of services. These conditions apply exclusively from the moment clients or students order their first free trial class with Gil or their first regular class with Gil.

Article 2 | Age limit

Students must have 18 years old minimum to receive any of the classes with Gil. Students from 12 to 17 years old must be accompagnied by a parent or a tutor during the first meeting of the free trial class. Both parents (or tutor) and teenager will sign an official discharge before the beginning of the regular classes. Both parents and teenager will de facto accept the present general conditions.

Article 3 | Services sold in form of packages of hours

All the classes are sold to the client-student under the form of packages of hours. There are two types of packages. Each package has a certain time validity exposed on the website. For more info on this topic see reimbursment and cancellation articles :

  • Packages for conversation classes with Gil with 3 different prices per hour depending on the number of hours of classes bought by the client-student :
    • 35 euros per hour for one hour
    • 32,5 euros per hour for five hours
    • 30 euros per hour for ten hours.
    • Prices are indicated all taxes included.
  • Packages for the regular classes with Gil with five different prices per hour depending on the number of hours of classes bought by the client-student :
    • 50 euros per hour for 1 hour
    • 47,5 euros per hour for 5 hours
    • 45 euros per hour for 10 hours
    • 42,5 euros per hour for 20 hours
    • 40 euros per hour for 50 hours.
    • The prices are indicated all taxes included. The regular classes include levels A1 to C2 classes, Youngsters learn french classes, French for businesses classes, Tests and diplomas classes support.

Article 4 | Selling procedure and formalities

a°/ Free trial first : Before buying hours of classes, clients-students are invited to first meet Gil for a one hour free trial class. Gil reserves himself the right to refuse to sell packages of hours of classes to clients-students before, during or after the free trial class. Clients-students are as well free not to buy Gil’s classes before, during or after the free trial class. The free trial class is offered to clients-students without obligation to buy. The free trial class with Gil online is here to bring all parties in contact. This way they can take time to agree about the way the learning process should be proceded (scheduling possibilities, levels adaptation, orientation of French learning toward clients interests, etc.) and eventually start a free lesson during this free hour.

b°/ Time availabilities for free trials: All clients-students are welcome for an hour free trial without obligation under the reserve of Gil’s time availabilities. They will send a request through the contact form or directly to Gil’s email address ; or phone number +32 465 97 32 37 to schedule a free trial class with him.

c°/Decision to buy, contract, invoice : During or after the free trial class, students decide to follow or not the classes offered by Gil online. When they choose to buy hours of classes, students send a written request to Gil with their details and will receive an invoice, an electronic payment order emitted by SMartcoop (see Article 6), the Belgian cooperative for Salaried Entrepreneurs, madated by Gil to emit the legal documents that regulate the relations between Gil and his clients. SMartcoop is a trusted third party between Gil Filiot and his clients-students, guarantor of the contract’s fulfillment by all parties under Belgian and European law.

d°/ Electronic signature : The electronic payment order sent by SMartcoop to the client-student is an invoice the client-student must sign electronically once received. The invoice electronically signed is automatically sent back to SMartcoop. The signed invoice has the value of an obligation of payment once signed by the client-student and received back by SMartcoop. The client-student has then 10 days to pay the total fees’ amount. Note also that the payment must be received at least 24h before the first scheduled class starts.

Article 5 | Withdrawal period, class cancellation and reimbursment conditions

a°/ 14 days to withdraw : The client-student has 14 days to withdraw from his engagment to pay and follow the classes with Gil once he has signed the invoice sent by SMartcoop. He will write a letter and send it to Gil’s email address. The order to reimburse the client within the shortest period of time will be given to SMartcoop. An amount of 50 euros will be deduced from the total amount to reimburse for the administrative formalities and costs of transfer.

If the client-student wants to see his classes to start before the expiration of his right to withdraw, he will simply email it to Gil so as to have a written proof of the demand. Even if the client-student wants to start his classes before the expiration of his right to withdraw, this condition does not invalidate his 14 days right to withdraw.

In case the client-student expressly asked to start the classes before the expiration of his right to withdraw, the hours already taught will be due and deduced from the total reimbursment’s amount in case of withdrawal.

b°/ After the classes have started, whether it be before or after the end of the 14 days withdrawal period : The client-student can still withdraw from his engagment to follow the classes and receive a refund after the 14 days withdrawal period. Whether it be before or after the end of the 14 days withdrawal period, the refund amount will be calculated in relation to the number of hours of class already taught, and the price per hour of the classes already taught will be recalculated in function of the package into which this number of hours falls. If a client-student has bought 50 hours of class at 40 euros per hour, and if the client-student withdraws from his engagment after he has been taught 15 hours, the price per hour of the 15 hours already taught will be calculated in function of the « 10 to 20 hours package » and not in function of the « 20 to 50 hours package » where the price per hour is cheaper (see Article 3).

Once the price per hour is recalculated, multiplicated by the number of hours taught and deduced from the total amount the client-student paid, 50 euros will be deduced for administrative and transactional costs.

c°/ 48h to cancel a class : In case a class that had been scheduled by the student-client needs to be cancelled for any reason by the client-student, the latter must let know Gil 48h in advance otherwise the number of hours reserved will be due and deduced from the client-student account.

d°/ Package limit of validity : Each package of hours has a limit of validity calculated on a minimal base of 1 hour of class per week. The time validity period starts once the 14 days withdrawal period is finished. Student-client can ask a refund of the classes within the time validity of each package. The client-student will not be able to receive a refund after the end of the time validity. The client-student will receive a reminder from Gil before the end of the time validity.

Article 6 | SMartcoop

a°/ Status : SMartcoop is a cooperative company with limited liability (SCRL) and a social purpose company (SFS). Productions associées BCE/TVA: BE 0896.755.397

c°/ SMartcoop’s missions are to :

  • Establish and send the bills to Gil’s clients once the latters have ordered French classes
  • Receive the money from the bills paid by the clients and the amounts agreed to be paid in the conventions contracted by Gil and the clients
  • Engage Gil to work to the realisation of the activity of teaching French to foreigners and assumes the social and fiscal obligations linked to these engagments under the belgian law.
  • Pay Gil’s salaries.
  • Assure the production of Gil’s teaching activity, assume its administrative managment, do the accounting and present the accounting.
  • Reimburse clients in case of withdrawal
  • Provide legal services to Gil and the clients in case of litigation

Article 7 | Gil's obligations

a°/ quality engagment : Gil engages himself to give all care and all diligence necessary to the delivery of a service of quality in accordance with the usages of the teaching profession and the state of the art. If Gil gives himself the task to bring students to the next levels, he can only respond for an obligation of means.

b°/ delivery of the classes : Gil engages himself to deliver every hour of class the client-student has ordered. Gil engages himself to attend all the classes scheduled with the clients-students. In case Gil cannot attend the class, Gil will notify the client-student 24h in advance. If he cannot give the notification 24h in advance the class will be offered to the client to compensate the late notification. The class will then be rescheduled according to client-student’s will.

Article 8 | Attendance certificate

Gil delivers to clients-students, on demand, certificates of attendance. These certificates can only be delivered after the integral payment of the due amounts.The attestation will take into account the date and length of each class the client-student attended. The certificate will not be delivered later than 6 months after the last class attended.

Gil may ask clients-students to sign an attendance sheet at the beginning of every class they receive.

Article 9 | Applicable legislation and competent court

The present general conditions are submitted to the belgian legislation. In case of litigation the Belgian juridictions in french language will be competent.

Article 10 | Prices and means of payment

The costs of the classes are the object of a price grid exposed on the front page of the website. These costs are all taxes included as they are also VAT exonerated in virtue of the article 44§2.4° of the belgian VAT code.

The due total amount for the classes must be paid before the beginning of the first class (see Article 3). The transaction costs are borne by the clients.

The cooperative SMartcoop, to whom the client-student will pay the fees for the classes, accepts bank transfers as a mean of payment. If clients-students prefer to pay with other means of payment like paypal or credit card, they will pay directly Gil who will then pay SMartcoop through bank transfert. And in all cases the client will receive invoices, contracts, proof of payments from SMartcoop. In case clients pay throught paypal or credit cards, they will receive a receipt from Gil.

Article 11 | Personal data and privacy policies

The client is informed that Gil only collects personal data clients have given voluntarily. These information are collected for the normal functioning of the commercial relation with Gil. The data collection is submitted to the Belgian law on life’s privacy of the 8th of december 1992, modified by the law of the 11th of december 1998. These informations are collected to serve the relation with the client and to take care of the fulfillment of the legal obligations of all parties.

The client also aknowledges that his personal data are transmitted to SMartcoop’s judicial and financial services which keep a record of the data in order for Gil’s activity of teaching to comply with the Belgian law.

SMartcoop and Gil engage themselves not to communicate the personal data of the clients to any third parties, except to the Belgian autorities if the latters ask the data to be transmitted to them under judicial order.

The clients have the right to have access to their data and a right to modify or completely suppress them. They can exercise this right by writing an email to Gil’s address : and also to SMartcoop at one of their email address that can be found at the SMartcoop article of this General Conditions of Services.

Gil reserves himself the right to verify the authenticity of the information given by the client in order for his activity to function and to comply with Belgian laws’ requirements.

If the informations of the client came to change in the course of the relation, the client must notify Gil of these changes in order for the contractual relation to be continue normally.

Article 12 | Modification

The general services conditions can be modified anytime. The parties agree that Gil has the right to modify his services without any other formalities but to write a notification to the client. Gil will take care that his clients have well understood the modifications. Any modification and new services’ options will be the object of an announcement on the website and through an email letter sent to the clients. In case the clients disagree with the modifications, they will have 30 days to cancel their contract with Gil from the day the modifications are effective, this without any additional costs deduced from the reimbursment for administrative or transaction costs. The classes already taught will be due and deduced, but the price per hour of the classes already taught will not be recalculated to reimburse the client. The same price per hour as the one the client paid when the contract was signed will be applied.
